Yo Marketing Agency and its affiliates (“Yo Marketing,” “we,” “us,” or “our”) respect your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your data when you visit our website at yomarketing.agency (the “Site”), access our Marketing-as-a-Service software platform and application at yomarketing.ai (the “Yo App” or “Platform”), utilize our diagnostic tools (such as the “Yo Score”), or engage our fractional marketing and consultancy services (collectively, the “Services”).
Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please discontinue use of our Site and Services.
1. Scope & Our Role
Depending on how you interact with us, Yo Marketing may act as either a Data Controller or a Data Processor:
• Data Controller: We act as a Controller when we collect personal information directly from visitors to our Site, subscribers to our newsletters, prospective clients who request a Yo Score, and registered users of our Yo App accounts.
• Data Processor / Service Provider: When agency clients use our Services or platform to manage their own campaigns, customer lists, CRM integrations, or audience data, Yo Marketing processes that information strictly as a Processor on our client’s behalf, governed by our client contracts and Data Processing Agreements (DPAs).
2. Information We Collect
We collect information directly from you, automatically through your use of our Services, and from trusted third parties.

• Account & Registration Credentials: Usernames, passwords, and profile details created when setting up access to the Yo App or client portals.
• Billing & Payment Information: Billing address and commercial transaction records. (Note: Payment card details are processed directly by our PCI-DSS-compliant payment processors; we do not store full credit card numbers on our servers).
• Assessment & Diagnostic Inputs (Yo Score): Website URLs, brand domains, industry categorization, and business goals submitted to generate audits or scoring benchmarks.
B. Information Collected Automatically
• Device & Usage Telemetry: IP address, browser type, operating system, device identifiers, referring URLs, pages viewed, time spent on pages, clickstream data, and interaction timestamps.
• Cookies & Tracking Technologies: We utilize first-party and third-party cookies, web beacons, and session identifiers to facilitate site navigation, track analytics (such as Google Analytics), maintain user sessions, and record cookie consent preferences.
C. Information from Third Parties & Integrations
• Platform Integrations: If you connect third-party accounts (e.g., Google Analytics, CRM platforms, advertising networks) to the Yo App, we receive data authorized via those integrations in accordance with your permission settings.
• Public & Commercial Sources: Publicly available business records, LinkedIn profiles, and verified B2B contact registries used for sales outreach and business development.
3. How We Use Your Information
We process personal information for the following business and commercial purposes:

4. Legal Bases for Processing (EEA, UK, and Applicable Jurisdictions)
If you reside in the European Economic Area (EEA) or the United Kingdom, our legal bases for processing your personal data include:

5. How We Disclose Your Information
We do not sell, rent, or trade your personal information. We disclose data only under the following circumstances:

Managing Preferences: You can manage or update your cookie selections at any time through the cookie settings banner on our Site. You may also configure your web browser to reject cookies; however, certain interactive platform features may not function properly without essential cookies enabled.
8. Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or litigation holds).
When data is no longer required, we securely delete, destroy, or permanently anonymize it. If you close your Yo App account, we delete or disassociate your personal data within standard backup recovery cycles, subject to residual business recordkeeping requirements.
9. Data Security
We implement commercially reasonable technical, administrative, and organizational safeguards designed to protect personal information against unauthorized access, destruction, loss, alteration, or disclosure. These measures include encryption in transit (TLS/SSL), restricted role-based access, and secure cloud infrastructure. However, no transmission over the Internet or electronic storage system is 100% secure, and we cannot guarantee absolute security.
